RULING ON MOTION ON NOTICE FOR EXTENSION OF TIME TO FILE NOTICE OF APPEAL This application is brought by the defendant/applicant under Rule 9 (1) (a) & (b) of the Court of Appeal Rules, C.I 19 of 1997. The gravamen of the defendant's application is that the Court then presided over by Abada J. gave judgment against it on 6th of June, 2019 and yet it had not received a copy of the judgment. The defendant says that it wishes to appeal the said judgment though the time for filing appeal had elapsed. He therefore craves the indulgence of the Court to extend time for him to file the notice of appeal for the appeal to be determined by the Court of Appeal. The plaintiff/respondent is opposed to the application on the ground that the defendant/applicant has not demonstrated a compelling reason for which the Court's discretion should be exercised in the defendant's favour.
