RULING ON MOTION ON NOTICE FOR INTERLOCUTORY INJUNCTION Order 25 rule 1 (1) of the High Court (Civil Procedure) Rules, 2004 (C.1. 47) provides as follows: “The Court may grant an injunction by an interlocutory order in all cases in which it appears to the Court to be just or convenient to do so, and the order may be made either unconditionally or upon such terms and conditions as the Court considers just”. It is under this rule that the Plaintiff/Applicant, hereinafter called the Applicant, brought the present application for interlocutory injunction against the Defendants/Respondents hereinafter called the Respondents to restrain them and their agents or privies from interfering with the Applicant’s possession of the land which is the subject matter of the substantive suit pending the final determination of the suit.
