i. Introduction: [1] The Plaintiff’s purchase of a property at an auction conducted by the Judicial Service is the centerpiece of this litigation. In October 2012, the Plaintiff purchased the property located at “DF17, Race Course”, Bungalow House at a cost of GH¢65,000.00. After the purchase the Plaintiff was issued with a Certificate of Purchase duly signed by a Judicial Officer to confirm the sale. According to the Plaintiff he renovated the property and put tenants in possession of the house. [2] Further to certain orders made by the High Court differently constituted, the Plaintiff’s ownership was legally challenged by the Defendant herein. Consequently, on August 13, 2015, the Plaintiff commenced the instant action against the Defendant, seeking a declaration that he is the owner of the property described above.
