NAOMI THERESAH SHANG-QUARTEY vs. ACCRA METROPOLITAN ASSEMBLY AND ALFRED OKOE VANDERPUIJE
i. Introduction: [1] The suit is against a former Chief Executive Officer of the Accra Metropolitan Assembly (AMA), and the AMA as an institution established by Statute which is the highest political authority in the Accra Metropolitan Area by virtue of clause 3 of Article 241 of the 1992 Constitution and Section 3(1) of the Local Governance Act, 2016 (ACT 936). The Amended Writ of Summons together with the Statement of Claim in this matter was issued on June 24, 2015. I note that the overarching substantive relief sought by the Plaintiff in this action is for the current value of the demolished four bedroom storey house valued at Gh₵120,000.00. The Plaintiff is also claiming adequate compensation and/or damages resulting from the demolition, as well as cost against the Defendants. [2] After the service of the writ and its accompanying statement of claim on the Defendants, Appearance was entered after which a statement of defence was filed by the Defendants on February 25, 2016.....
