ELIZABETH ACKON vs. STEPHEN OSAE

i. Introduction: [1] The Plaintiff, Elizabeth Ackon, agreed with the Defendant, Stephen Osae for the purchase of his building in or about the year 2009. According to the Plaintiff she first negotiated with the Defendant for the purchase of the building for her sister who is ordinarily resident in the United States of America (USA). The parties agree that the purchase price agreed to was GH¢30,000, but the Plaintiff contends that there was an additional GH¢2,000 agreed to for the preparation of the documents. The Defendant says the Plaintiff made an initial payment of GH¢15,000 and promised to pay the remaining balance within six months from the date of sale. According to the Defendant the Plaintiff did not pay the balance of GH¢15,200 as agreed but rather the Plaintiff paid GH¢1,000 after a period of ten (10) months, leaving the balance of GH¢14,200.
