Introduction: [1] It is the case of the Plaintiff that in or about April 2013, the Defendant, Mr. Daniel Quarcoo collected an amount of Ten Thousand Ghana Cedis (GH¢10,000) from him as part of an agreement for a parcel of land situate at Dunkoona in the Greater Accra Region. According to the Plaintiff the agreement was put into writing and he spent additional sum of Thirty Thousand Ghana Cedis (GH¢30,000) over building materials and building a foundation. The Plaintiff further contends that the Defendant eventually did not make the land available to him and gave it to another person but promised to refund the amount of GH¢40,000 to him. [2] The Plaintiff contends that the Defendant refunded an amount of GH¢5,000 as initial payment and promised to pay the balance of GH¢35,000 within a month.
