RULING MOTION ON NOTICE TO SET ASIDE/VACATE THE ORDER SUSPENDING THE 2ND DEFENDANT’S LAND CERTIFICATE i. Introduction [1] The present application seeks to set aside an order made by this Court differently constituted to suspend the 2nd Defendant/Applicant’s Land Certificate pursuant to the inherent jurisdiction of the Court. The background to the application is that sometime in 2015, the 1st Plaintiff commenced the instant action against the 1st Defendant, being the Executive Secretary of the Lands Commission for certain reliefs endorsed on the Writ of Summons. Further to the filing of the Writ of Summons on July 2, 2015 the sole Plaintiff at the time filed a “Motion on Notice for Interim Injunction” against the Defendant. On July 23, 2015 the Court presided over by Anthony Kofi Abada J (as he then was) granted the application in the following terms as per the Order exhibited as Exhibit “A” in this application.
