ANTHONY ATTA POKU vs. KOJO DORBOR & 2 ORS

The plaintiff, Anthony Atta Poku, claimed title to Plot No. 626, East Legon Residential Area, Accra, based on a lease granted by the Government of Ghana through the Lands Commission in 1988. He alleged trespass by the defendants who erected structures on the land without authority. The 3rd defendant claimed title through his late mother, who purportedly acquired the land from a private individual before her death in 1995, and that he had been in possession since then, with the 1st defendant as his caretaker. The plaintiff denied the 3rd defendant's claim, asserting the land is State land and the 3rd defendant's presence was trespass.
