THE REPUBLIC vs. SAYI NDAH AND 3 OTHERS (RESPONDENTS) EX PARTE: NANA NYANZU ANGOFI II AND DIVISIONAL CHIEF OF ELUBO CHIEF’S PALACE ELUBO (APPLICANT)
The facts of these contempt proceedings are fairly simple and admit of little controversy. At the forum of the Judicial Committee of the Western Regional House of Chiefs, the respondents (excluding the 4th) engaged the applicant in a chieftaincy litigation over the latter’s nomination, election and enstoolment as the Odikro of Elubo. On the 8th of November 2017, the Judicial Committee delivered a verdict against the applicant essentially declaring as invalid his nomination, election and enstoolment. An order was made restraining him from holding himself out as the Odikro of Elubo. The Judicial Committee however, did not give reasons for the verdict the same day. It did so on the 29th of November 2017, the date fixed for the purpose.
