ACCESS BANK (GHANA) LTD. (PLAINTIFF) vs. MANSELL GHANA LIMITED, RAMI EL-ASHKAR AND DR. RADWAN EL-ASHKAR (DEFENDANTS)

On the 5th March 2019, the applicant herein caused an Originating Motion on Notice to issue against the respondents herein under the Borrowers and Lenders Act, 2008, Act 773. In the said motion, the applicant sought reliefs against the respondents in the nature of: (1) An order to exercise the right of possession of Parcel No. 36 Block 1 Section 42, South Industrial Area and Parcel No. 121 Block 1 Section 30 situate at Accra Central, the properties subject to the charge. (2) An order to realise the security in all that piece or parcel of land in extent of 0.826 acres more or less being parcel No. 36 Block 1 Section 42, South Industrial Area situate within the Greater Accra Region and subject to the charge. (3) An order to realise the security in all that piece or parcel of land in extent of 0.159 acres more or less being Parcel No. 121 Block 1 Section 30 situate at Accra Central within the Greater Accra Region and subject to the charge.
