BOND SAVINGS & LOANS LTD (PLAINTIFF) vs. ZEKIEL HOMES LTD & 4 ORS (DEFENDANTS)

This is an application for leave to go into execution. I have read the application and the affidavits filed by the parties. I have given consideration to all the circumstances of this case. Regard has also been given to the fact that the Defendants/Judgment/Debtor/ Respondents have been given ample time to settle their indebtedness to the Plaintiff/Judgment/Creditor. It is now clear that the Defendants/Judgment/Debtors have failed to fully comply with the Consent Judgment of the Court. In the circumstance, I do not think the Plaintiff/Judgment/Creditor should be denied its right to go into execution. In the circumstance, I grant the application. Leave is accordingly granted to the Plaintiff/Judgment/Creditor/Applicant to go into execution. I make no order as to costs.
