CAPITAL BANK GHANA LIMITED (IN RECEIVERSHIP) (PLAINTIFF) vs. WILLIAM ATO ESSIEN & ORS. (DEFENDANTS)
On the 2nd November, 2018, the Plaintiff issued a Writ of Summons against the 1st Defendant and 15 others. On the 6th November, 2018, the 1st Defendant was served with the Writ of Summons. On the 12th November, 2018, the 1st Defendant entered an appearance through his Lawyer, George Bernard Shaw. Then on the 15th November, 2018, another Lawyer Hanifa Yahaya also entered an appearance for the 1st Defendant. On the 5th December, 2018, Lawyer Samson Lardi Anyenini also filed another process as an Additional Solicitor for the 1st Defendant. Counsel Samson Lardi Anyenini then proceeded to file a Statement of Defence for the 1st Defendant on the 13th December, 2018. Then on the 13th December, 2018, a Notice of Change of Solicitors was filed by Samson Lardi Anyenini of A – Partners @ Law for and on behalf of the 1st Defendant. It is against this background that the Plaintiff has brought the present application seeking to strike out the Entry of Appearance filed by Hanifa Yahaya, Sams.....
