DELICO ACHIMOTA GHANA LIMITED (PLAINTIFF) vs. PALACE SHOPPING MALL LIMITED & ANOR (DEFENDANTS)

This is an application for reconciliation of accounts. I have read the application and the affidavits in support and in opposition of the application. I have given consideration to the oral submissions of both Counsel. Further consideration has been given to the principles governing the grant of application of this nature. I have also given my thoughtful consideration to the Order 29 rule 2 of CI. 47 and I am of the view that this is a proper case for the Court to order parties to go into accounts for the purposes of reconciling the accounts between the parties. I must say that I am persuaded by what Counsel for Defendant said regarding the cost involved in these matter. I am however inclined to grant the application for the accounts to gone into so as to narrow the issues and the volume of evidence that may be tendered in the trial, if any.
