FIDELIA ALIPUI (PLAINTIFF) vs. CHRISTIAN KUMORDZI & ANOR. (DEFENDANTS)

This is an application by Interlocutory Injunction brought by the Plaintiff/Applicant. I have read the application and the affidavits filed by the parties. I have also read the statement of case filed by both Counsel. Regard has been given to Order 25 of CI. 47 and the principles governing the grant or refusal of applications of this nature. I must say that I do not find any merit in the present application. The Defendants have satisfied all the requirements imposed by the law regarding the erection of such edifice on the land. I do not also find any infringement of the Plaintiff’s right in any form by the erection of such an edifice. No hardship or inconvenience, from the facts before me, shall be suffered by the Plaintiff when the said edifice is completed. Consequently, I refuse the application. No order as to costs.
