This is a motion for an order by the Plaintiff/Applicant to strike out pleadings pursuant to Order 18 Rule 1 of CI 47 and the inherent jurisdiction of the Court. The Applicant in arguing its grounds made the following submissions: On the 3rd of July 2018, she caused a Writ of Summons and Statement of Claim to be issued against the Defendant herein (hereinafter referred to as “Respondent”). The Respondent entered a conditional appearance through his Lawyer Dela Blagogee Esq. on the 16th of August 2018 and further filed a Statement of Defence in the action on the 11th of October 2018. The Plaintiffs says paragraphs 16, 21, 26, 29 and 31 of the Statement of Defence are scandalous and frivolous. At paragraph 16 of the Statement of Defence, the Defendant avers that the property was at all material times under the care of his nephew, Mr. Emmanuel Boakye and inhabited by a caretaker, Mr. Alex whom the Plaintiff forcefully threw out of the property because she felt her amorous escapade...
