EBENEZER LANQUAYE BRUCE & ANOR. (PLAINTIFFS) vs. BENEDICT PETERSON (DEFENDANT)
The parties entered into a transaction for the sale and purchase of two plots of land at Kasoa in the Central Region. After some negotiations with Plaintiffs at different times, the Defendant paid the sum of GH¢140,000.00 to the Plaintiffs as the cost of the land. The Defendant was put in possession of the land by the Plaintiffs. Subsequently, the Plaintiffs called on the Defendant to pay an alleged sum of GH¢60,000.00 as an outstanding balance of the cost of the land. It is the case of the Plaintiffs that the land was priced at GH¢200,000.00 and the Defendant paid GH¢140,000.00 leaving a balance of GH¢60,000.00. The Defendant contends that the agreed price was GH¢140,000.00 which he had fully paid to the Plaintiffs before he was put in possession.
