ROCKSHELL INTERNATIONAL (PLAINTIFF) vs. ACCESS BANK GHANA LIMITED & ANOR. (DEFENDANTS)

The Defendant herein obtained a judgment against the Plaintiff herein in Suit No. BFS/71/2014 entitled ACCESS BANK GHANA LIMITED v ROCKSHELL INTERNATIONAL LIMITED AND ANOTHER. In an attempt to enforce the judgment, the Defendant herein attached certain properties of the Plaintiff herein by the issuance of a Writ of fi fa. During the process of execution, an excavator belonging to the Plaintiff herein, was also attached. In the course of attachment, the Defendant through its officers or agents hired a low loader truck to convey the said excavator from the site of the Plaintiff herein. In the process something happened and the conveyance of the excavator was stopped. It is as a result of what happened that the Plaintiff has issued the present Writ of Summons asking for the following reliefs: (1) An order that the Defendant pay for the repair of Plaintiff’s excavator with Serial Number 9TZ000447. (2) An order that Defendant pay Plaintiff the daily sum of USD2, 500.00 from 12th May.....
