TATA AFRICA HOLDINGS GHANA LIMITED (PLAINTIFF) vs. FAIRLLOP INTERNATIONAL LIMITED (DEFENDANT)
On the 3rd of July 2015, the Plaintiff filed the present suit against the Defendant asking for the following reliefs: 1. An order for the payment of the amount of USD$147,562.00 being the outstanding balance on the dealership agreement with Fairllop Liberia, by the Defendant to the Plaintiff. 2. An order for the payment of interest on the said amount at the Commercial Bank lending rate from the 1st of August, 2012 to the date of final payment. 3. Damages for breach of contract. 4. Cost When the writ of summons and statement of claim were served on the Defendant on the 11th July, 2015, the Defendant entered appearance through its Counsel on the 24th July, 2015. The Defendant then went to sleep. It failed to file a statement of defence within the time stipulated by the rules of Court. The Plaintiff therefore filed an application for judgment in default of defence.
