RICHARD KORANTENG (PLAINTIFF) vs. UNISECURITIES GHANA LIMITED (DEFENDANT)

This is an application for Summary Judgement. I have read the application and the supporting affidavit. It is noted that the Defendant did not file any affidavit in opposition. Thoughtful consideration has been given to Order 14 rule 1 of CI. 47 which provides that: “Where in an action a Defendant has been served with a statement of claim and has filed appearance, the Plaintiff may on notice apply to the Court for judgment against the Defendant on the ground that the Defendant has no defence to a claim included in the Writ, or to a particular part of such a claim, or that the Defendant has no defence to such a claim or part of a claim, except as to the amount of any damages claimed.” A summary of the facts of the case is that on the 28th June, 2018 the Plaintiff invested an amount of gh¢1,665,350.66 in the Defendant Company at the agreed rate of 30% per annum as interest and was given an account number; 2041020002901 which account is hosted at the office of the Defendant.
