EMMANUEL XEXEMEKPE vs. THE JUDICIAL SERVICE AND THE ATTORNEY GENERAL

It is the plaintiff’s case that sometime May 2015, he was in office when a gentleman he assumed to be a court user approached him saying he needed assistance in the making of an affidavit with an attestation for a document he was sending to Australia. Plaintiff says he contacted a Commissioner for oaths to prepare the documents for the gentleman and she charged GHC350.00. Plaintiff goes on that since the Commissioner for Oaths was not available at that time, she asked the plaintiff to collect the amount and documents on her behalf so that she could prepare the affidavit and subsequent attestation for him. The plaintiff further says the documents were prepared by the Commissioner for Oaths who handed same to him to be given to the gentleman on an appointed date.
