DANIEL GATOGO vs. TORGBI KPONOR AND YAO SEGBEDZI
A. INTRODUCTION 1. On the 14th of September, 2016 the Plaintiff/Respondent (hereafter Respondent) issued a writ of summons at the District Court, Ave-Dakpa, for a declaration that his Alikor/Gatogo Family owns a piece of land situate at Vorsakope near Avega. The boundaries of the land have been specified in the writ of summons which appears at pages 1 and 2 of the record of appeal. He also prayed for an order of recovery of possession of the said land, perpetual injunction and costs. 2. A plenary trial ensued, at which the Respondent testified and called two witnesses. The 1st Defendant/Appellant (hereafter 1st Appellant) testified for himself and on behalf of the 2nd Defendant/Appellant (hereafter 2nd Appellant). Appellants also called two witnesses.
