The Writ of Summons issued by Plaintiff against the Defendants sought declaration of title to a piece of land situate and lying at Okpoi-Gonno, Nungua; perpetual injunction to restrain the Defendants from encroaching and or developing the said land and damages for trespass. Plaintiff claims to have acquired the land from Nungua Stool in 1994. The land acquired consisted of two plots. Plaintiff entered the land and carried out acts of possession including construction of a platform. 1st Defendant then started constructing another platform on a portion of the land which attracted an objection from Plaintiff. In view of the 1st Defendant’s impervious stance to the objections and warnings of Plaintiff, the latter was constrained to issue a Writ of Summons against 1st Defendant and sought virtually the same reliefs as being sought herein.
