Plaintiff, a medical officer residing in the USA, was granted a 99-year lease over 0.553 acres at East Legon Extension, Accra, covering Plots 1 and 35. Plaintiff began construction on the plots, leaving the middle portion undeveloped for a clinic. Defendant entered the middle portion and constructed a fence, leading to conflict and police intervention. Plaintiff alleged Defendant's title was based on a forged indenture. Defendant claimed to have acquired the land initially from the Numo Nmashie family in 2003 and later from the Sanshie family in 2006 after disputes. On or about 30th September, 2006, Plaintiff who is a medical officer based in the United States of America was granted a 99-year lease of land by Nii Sodjah Obodai in his capacity as the Acting Chief of Mpehuasem, East Legon Extension, Accra. The subject matter of the lease which is said to be at a place called East Legon Extension (Mpehuasem), Accra covers an area of 0.553 of an acre and it consists of Plots 1 and 35. Plaintiff alleged that he started building on the two ends of the two plots of the land; leaving the middle portion undeveloped with the intention of using that middle portion for construction of a clinic.
