In 1995, Plaintiff claims he acquired the disputed land from Nungua Stool but in the course of registering it he was informed that the land was registrable or could only be registered under the Katamanso Stool, a Sub-Stool of Nungua. He therefore averred that he was constrained to procure another grant through an indenture from the Katamanso Stool in 2003. He claims further that the said land has been plotted at the Lands Commission as confirmed by a search report dated 17th June, 2016 carried out by the Oyibi Police Station. Plaintiff averred further that, under similar circumstances, he has acquired interest in an adjoining land measuring 31.81 acres from the same Katamanso Stool and that this land was a subject matter of a judgment dated 18th July 2011 he obtained in his favor from the Circuit Court, Accra constituted by Her Honor Nana Adwoa Coleman (of blessed memory).
