COMFORT OPOKU vs. MR. BRAKO
This is an appeal from the judgment of the District Court, Amasaman dated the 2nd day of March 2016. The appellant was the plaintiff at the trial court whiles the respondent was the defendant at the trial court. The plaintiff/appellant and the defendant/respondent are neighbours sharing a common border. The reliefs plaintiff/appellant claimed at the trial court are: 1. An order compelling the defendant to destroy the Manhole he has constructed on a portion of plaintiff’s land at Taifa Railway Line and give vacant possession of the area he has constructed the Manhole. 2. An amount of GHC4000 being the cost of plaintiff’s building which defendant pulled down, destruction of 6 inch sandcrete blocks and destruction of a fence wall. 3. General damages for trespass unto plaintiff’s land. 4. Perpetual injunction restraining the defendant, his assigns, workmen and customary successors from interfering with plaintiff’s use of the land.
