BRADCO GHANA LTD (FORMERLY BRADCO TRADE ASSOCIATES GHANA LTD) vs. MICHAELNII YARBOI ANNAN, ALFRED ANNAN AND HENRY OKO ANNAN
The plaintiff company took out a writ of summons against the Defendants at the Registry of this court on the 8th day of February, 2019. This was accompanied by a statement of claim. The writ was endorsed with a claim as follows: i) A declaration of title to the piece or parcel of land with a structure thereon being Parcel No 103 Block 13 Section 031 situate at James Town on Registry Map No. 004/031/1991 with Land Certificate No. 23365 in extend of 0.15 hectare or 0.37 of an acre. ii) Recovery of possession. iii) Damages for trespass. iv) Perpetual injunction restraining the Defendants their agents, workers, assigns, privies howsoever described from dealing with the subject property pending the final determination of the action. v) Any just and equitable reliefs. vi) Costs. When served, the Defendants entered conditional appearance to the writ of summons and subsequently brought an application to strike out the Plaintiff’s writ of summons and statement of claim .....
