This Court differently constituted on 31st January, 2017 delivered judgment in this suit in favour of the Plaintiff/Respondent. The Defendant/Applicant appealed against same to the Court of Appeal which unanimously dismissed the appeal and affirmed the judgment of the trial High Court. On the 21st day of March, 2019 the Plaintiff/Respondent filed an Entry of Judgment and subsequently brought a motion ex-parte for leave of the court to serve the Entry of Judgment on the Defendant/Applicant by substituted service. This application was granted by this court on the 10th of April, 2019. The Defendant/Applicant in the instant application is praying this court to set aside the Entry of Judgment filed on 21st March, 2019, motion ex-parte for leave to serve the entry of Judgment by substituted service dated 29th March, 2019 and the order for substituted service dated 10th April 2019 of the Entry of Judgment dated 29th March, 2019.
