On the 16th day of November, 2017 the Plaintiff sued the Defendant in this court for the following reliefs: i) A declaration that the High Court judgment obtained by Augustus wiafe in January, 1999 against the Plaintiff herein in suit No. 325/90 respecting the state acquired land described in paragraph (2) of the statement of claim was procured by fraud . ii) An order that the judgment aforesaid and affirmation (8) thereof by appellate courts are vitiated by fraud and nemo dat quod non habet iii) A declaration of title to the subject matter property described in paragraph (2) of the statement of claim. iv) Recovery of possession v) Mesne profits vi) General damages vii) Costs The Defendant entered appearance to the action on 30th November, 2017 and filed a statement of defence to same on 11th December, 2017.
