The Plaintiff took out of the Registry of this court a Writ of Summons against the Defendants on the 6th day of November, 2018. This was accompanied by a statement of claim. The Plaintiff’s claim is for a declaration of title to a parcel of land, recovery of passion of the said parcel of land and perpetual injunction against the Defendants from interfering with the Plaintiff’s enjoyment of the subject land. On the same day the writ was issued, the Plaintiff filed a motion on Notice for an order for interlocutory injunction to restrain the Defendants from interfering with the subject land until the final determination of the suit. The writ of summons and accompanying statement of claim together with the motion on notice for interlocutory injunction were all served on the 1st Defendant by substituted service.
