ERIC NARTEY ENGMAN vs. AFUA KUNADU AMANKWAA

The Plaintiff/Respondent commenced an action against the Defendant/Applicant by a writ of Summons issued from the Registry of the High Court on the 4th day of April 2015. The said writ was endorsed with the following claim. a) A declaration that the Defendant is in breach of the fundamental covenant of the lease dated 10th February, 2006 to use the land for residential purposes only. b) Recovery of the land as a result of the breach. c) General damages for breach of covenant. d) Costs e) Any other reliefs. The Defendant failed to enter appearance and was served with all processes in connection with this suit by substituted service. In the end judgment was entered against the Defendant on the 4th day of July, 2016 after the Plaintiff had given evidence in support of his claim. The Defendant was served with Entry of judgment on 12th April, 2017 and finally execution was carried out by Bailiffs of this court on 20th December, 2018 with the assistance of the police.
