The High Court on 14th November, 2014 gave a final judgment in favour of the Defendant/Respondent/Applicant in the above-named suit. Dissatisfied with the judgment the Plaintiff/Appellant/Respondent filed an appeal to the Court of Appeal. On 13th May, 2015 the Court of Appeal granted an application for stay of execution filed by the Respondent. Even though initially the record of appeal was dispatched to the appellate court following the issue of Civil Form 6, the appellate court granted an application for an order to rectify the record of appeal. This meant, the record of appeal had to be returned to the lower court for the rectification to be done.
