Counsel for Defendants/Applicants moved a motion on notice for stay of proceedings in this Court pending the determination of contempt proceedings against 1st Plaintiff/Respondent in another Court. Hereinafter the 1st Defendant/Applicant would be called “Applicant” and the 1st Plaintiff/Respondent would also be called the “Respondent”. Counsel for Applicant contended in his argument in support of the application that the substance of the Plaintiff’s writ is based on a piece of land located at Ngleshie Amanfro and which said land is a stool land, and being a stool land Order 4 r 9 of C. I. 47 shows who can institute an action or issue a writ or defend an action in respect of stool land. Counsel also contended that the 1st Defendant/Applicant is the substantive chief of Ngleshie Amanfro and referred the Court to exhibit “A” annexed to this application.
