BY COURT: This is an application for interlocutory injunction by the plaintiff/applicant who seeks an order of this court to restrain the defendants from carrying out further development on the disputed land. He relied on the motion paper and supporting affidavit. The defendants particularly 1st and 2nd defendants vehemently opposed the application by their affidavit in opposition. They also filed exhibits which include an indenture - exhibit 1 containing a site plan, and the exhibit 2 series which are all photographs to show that the 1st defendant/respondent is in occupation of the disputed land after a grant made to it and has developed same. I have not seen any indenture or conveyance by which the plaintiff/applicant acquired the disputed land. It appears to me that the applicant by his affidavit evidence has not demonstrated that he has a right at law or in equity which this court must protect.
