COUNSEL FOR PLAINTIFF We have filed an application humbly praying the Honourable court to enter summary judgment against the Defendants herein for the reliefs endorsed on Plaintiff’s Writ of Summons as accompanied by the Statement of Claim. My lady, we move accordingly in terms of the motion paper, the supporting affidavit and the copious exhibits in corroboration of the Plaintiff’s case for summary judgment against the Defendants. My lady, we rely entirely on the processes as filed by Plaintiff but wish to add that we note the Defendants’ affidavit in opposition to Plaintiff’s motion for summary judgment but we take the view that same does not answer at all the case of Plaintiff for summary judgment before the court. My lady, we take that view because the only issue that can be observed from Defendants’ opposition is the unfounded allegation that the Plaintiff has not exhausted the steps precedent to coming before this court for relief.
