The Plaintiff issued a writ of summons together with a statement of claim from the registry of this Court on 29th October 2013. The writ was later amended and the reliefs contained in the Amended Statement of Claim filed on 16th April 2014 are: a. A Declaration of title to land measuring 9.06 acres or 3.67 hectares at Katamanso. b. Recovery of possession of the said land. c. An order of perpetual injunction to restrain the Defendants, their agents, workmen, assigns etc. d. General and special damages for trespass and destruction of plaintiff’s boundary pillars. e. Costs for bringing this action. Upon being served with the Writ and the Statement of Claim, the Defendants e3ntered an appearance and followed up with a Defence which contained a Counterclaim on 30th April 2015. After the close of pleadings, the following issues were set down as the issues for determination in the matter: a.
