GRANHILL LIMITED vs. ATLANTIC PORT SERVICES AND ATLAS MANUFACTURING & ENGINEERING CO. LTD.
A brief facts of the case are that the parties are Limited Liability Companies incorporated under the laws of the Republic of Ghana, except the third Defendant, which is a statutory body responsible for management and administration of public lands. The Plaintiff brought this suit as the lawful assignee of the subject matter plots of land it which it executed with Costas Glicofridis acting per his lawful attorney on 30th June 2008. According to the Plaintiff, the first and second Defendants were licensees of Costas Glycofridis, but failed to yield up vacant possession of the land, falsely claiming that they are his lawful assignees. As bona fide purchaser for value without notice of any adverse claim by the two Defendants, the Plaintiff considers itself entitled to the land, hence the commencement of the suit.
