NUMO OKAI I SUING FOR HIMSELF AND ON BEHALF OF THE GA-GBESES – KORLE STOOLS (PLAINTIFF) vs. LANDS COMMISSION, SOCIAL SECURITY AND NATIONAL INSURANCE TRUST, YOO MART LIMITED (DEFENDANTS) AND GBESE STOOL ACTING PER NII AYI BONTE II
There is an application on record by the Gbese Stool of Accra to be joined to the suit as fourth defendant. Counsel for Plaintiff opposed the application. The court ordered written arguments to be filed by counsel. Today I proceed to give a ruling on the matter. I have looked at the arguments filed in the Registry and placed on the case docket. The case of the Plaintiff is that he owes the property called SINGER HOUSE. According to Plaintiff this was compulsorily acquired by the state in the 1970’s. Presently it has been sold to 3rd Defendant – YOO MART by 2nd Defendant - SSNIT. Plaintiff is challenging the sale and is of the view that if the State no longer needed the property in accordance with the constitution it ought to have been given the first option to re-acquire same. Applicant for joinder if I understand it well is saying that there is no stool as Ga Gbese Korle Stool which owns land at Okaishie area of Accra.
