On 23rd March 2011, the Plaintiff caused to be issued from the Registry of this Court a Writ of Summons and a Statement of Claim. On 3rd February 2017, the Plaintiff endorsed the following reliefs on his Amended Writ of Summons: a. Declaration that the Defendant is liable for Plaintiff’s loss of his building. b. An order directed at the Defendant to extend the land he currently granted to the Plaintiff to its original size of 70 × 100 feet. c. An order directed at the Defendant to pay the sum of GH₵143,000.00 to the Plaintiff being the value of the building disposed. d. Interest on relief (c) at the prevailing bank rate from 16th July 2009 to date of final payment. e. General damages for loss of user of the building. Initial attempts to serve the Defendant with copies of the Writ proved futile so the Court ordered that he be served by substituted service pursuant to an application filed by the Plaintiff.
