Before me is an application for an order of interlocutory injunction to restrain the Defendants from developing the land in dispute pending the determination of this suit. In his pleadings and affidavit in support of the instant application, the Plaintiff claimed that he first acquired the land in dispute from Nii Okang Family in 1986 per Exhibit ‘A’. Subsequently, he attorned tenancy to the Afutu Brempong family when they won a suit against his grantors. In 2013, he was given a document, Exhibit ‘B’, by the Affutu Brempong family. The Plaintiff claims he took possession of the land in dispute after acquiring same in 1986 and put up a single room self-contained structure on it as shown in Exhibit ‘C’. According to the Plaintiff, the 2nd Defendant began her acts of encroachment in 2015 by holding church services in a pavilion on a section of his land.
