Before me is a motion on notice for interlocutory injunction filed by the Plaintiff/Applicant for an order to restrain the Defendant/Respondent from developing the land in dispute pending the determination of this suit. The Plaintiff’s case as gleaned from his statement of claim and affidavit in support of the application for injunction is that he acquired the land in dispute in 2005 from the Dua Dzaanor Family of Ofankor as evidenced by Exhibit ‘JA1’ which is a receipt for part payment of land bought at Ofankor. He claims that a lease evidencing the said transaction was executed by the parties in 2008 as shown in Exhibit ‘JA2’. The Plaintiff claims further that he deposited 5000 blocks on the land with the intention of putting up a building and put some caretakers on the land. Shortly thereafter, he travelled to Belgium but, while there, the Defendant trespassed onto his land and his grantor took her to Court.
