Before me is an application by Plaintiff/Applicant to amend the title to his writ of summons to reflect the correct name of the Defendant, namely Moses Yaw Asa-Akyea and not Moses Yaw Ansah as indicated on the writ by which this action was commenced. Counsel for the Defendant opposed the application to amend the title to Plaintiff’s writ of summons on the grounds that the said Moses Yaw Asa-Akyea is not the person named as the Defendant in the instant suit and, secondly, that he is not a proper party to be sued because he is not laying claim to any piece of land in Kwabenya. An examination of the affidavit in support of the instant application reveals that prior to the commencement of this action against the Defendant, the name and contact number of one Moses Yaw Ansah was given to the Plaintiff by workers that he found on the land he claims by this suit, as the person who authorized them to work on the land.
