Before me is an application filed by the 8th, 10th and 14th Defendants, referenced hereafter as the Applicants praying this Court for an order joining the Attorney General to the suit as 18th Defendant. Order 4 rule 5(2) (b) provides that: “At any stage of the proceedings the court may on such terms as it thinks just either of its own motion or on application, (b) Order any person who ought to have been joined as a party or whose presence before the court is necessary to ensure that all matters in dispute in the proceedings are effectively and completely determined and adjudicated upon to be added as a party.” In the suit before me, the Applicants have in their statement of defence and counterclaim sought the relief in the nature of perpetual injunction seeking to restrain among other persons, the Government of Ghana (G.O.G).
