In this application, the Plaintiff/Applicant (hereafter called “the Applicant”) prays for an order to strike out the pleadings in the amended statement of defence and counterclaim of the 8th, 10th and 14th Defendants/Respondents (hereafter called “the Respondents”) and their entire counterclaim. The case of the Applicant is that the said pleadings are an abuse of the court’s process and is an attempt to delay the fair trial of the dispute which is otherwise very simple as it involves the recovery of sums of money, which have been allegedly taken out of the accounts of uniBank Ghana Ltd, now in receivership. It is the further contention of the Applicant that the Respondents are barred by statute, specifically, the Banks and Specialised Deposit-Taking Institutions Act, 2016 (Act 930), from challenging the action of the Bank of Ghana (BOG) relating to the appointment of an official administrator and the appointment of a receiver in this forum.
