It is noted that Counsel for the Defendant/Judgment Debtor/Applicant did indicate to the court at the last sitting that he would be unable to attend court today due to a scheduling conflict and the court did exempt his attendance in court for that reason. Today, the suit is scheduled for a ruling to be delivered in respect of the Motion on Notice for Stay of Execution and Payment by Instalment filed by the Defendant/Judgment Debtor/Applicant in this case. I have reviewed the said application together with the supporting affidavit and the supplementary affidavit and all the annexures thereto. I have also heard from Counsel for both parties, as they set out the case of their clients. I have given my thoughtful consideration to the case law, authorities and the rules of court procedure.
