Before me is an ex-parte application filed by the Plaintiff/Applicant or Plaintiff seeking an Anton Piller order to issue against the 1st Defendant/Respondent or 1st Defendant, to allow the Plaintiff a right of entry into 1st Defendant’s premises to enable Plaintiff seize and obtain certain evidence relating to the Plaintiff’s claim now pending before the court. I have reviewed the application, the affidavit in support thereof, the annexures thereto and also given great thought to the averments put forth by Counsel for Plaintiff as he addressed the court today in addition to the statement of case filed by the Plaintiff in this matter.
