This is an application filed by the 3rd Defendant seeking to dismiss the Plaintiff’s suit upon grounds set out in the supporting affidavit. It is noted that the 3rd Defendant was originally not a party to the instant suit. The 3rd Defendant upon its own application was joined to the suit pursuant to the order of the Court entered on April 29, 2019. It is subsequent to its joinder that it has filed the present application to dismiss the Plaintiff’s action which seeks per the endorsement on the amended writ of summons the following reliefs: a.
