The Plaintiff is a business man trading in information technology. The Defendant is a business woman. The facts of the case as can be gleaned from the record are that the Defendant approached the Plaintiff sometime in 2013 with a request for financial assistance to the tune of twenty-three thousand Swiss franc (23,000.00 CHF) to enable her complete an oil transaction she was then engaged in. The Defendant agreed and the parties reduced this agreement into writing on April 10,, 2013 as evidenced by the Exhibit “BBL1”. The terms of the agreement pegged the fixed interest rate for the loan at 20% flat rate with the total amount payable being twenty-seven thousand six hundred Swiss franc (27,000.00 CHF) and the date for final payment as June 10, 2013. The agreement was witnessed by Defendant’s daughter, Fallila Issa Bawa.
