Plaintiff’s case is that in 2005, he and his ex-wife, Christiana Amoako jointly acquired a parcel of land from the Osu Wem family and the indenture evidencing this transaction was registered as AR/2570/2005. According to the Plaintiff, after acquiring the land, they secured it with corner pillars and built a foundation. Subsequently in 2015, they tried to sell it to one Kwodjo Bentsi Enchill but the deal fell through. Plaintiff claims that recently, the Defendant trespassed on this land and has started work on same. Plaintiff is therefore praying for declaration of title damages for trespass, recovery of possession and perpetual injunction against the defendant. In his application for injunction Plaintiff repeated the averments in his statement of claim and prayed for an order restraining the Defendant from developing the land in dispute until the determination of its rightful owner.
