This is an appeal from the judgment of the District Court Dodowa in Suit No A1/48/14 delivered on the 29th May 2017 in favour of Plaintiff. 3rd Defendant being dissatisfied with the judgment filed a Notice of Appeal on the 14th June 2017 with seven (7) grounds of Appeal. The Record of Appeal was submitted to this Court on 6th November 2017. In this Appeal, Plaintiff/Respondent will be referred to as Plaintiff and 3rd Defendant/Appellant will be referred as Defendant. Plaintiff sued the 1st and 2nd Defendants for declaration of title to land situate at a place commonly known and called Apetetsi (Apertekyi) at Dodowa measuring 115.0 feet x 100.0 feet x 198.9 feet x 198.1 feet, recovery of possession and perpetual injunction against Defendants and their agents. The Court ordered that 3rd Defendant be joined to the suit after 1st and 2nd Defendants informed the Court that they were placed on the land by one Enoch Tei Aperkon.
