The Defendant/Applicant was sued by the Plaintiff/Respondent for declaration of title to the land in dispute, recovery of possession, perpetual injunction and damages. At the end of a full scale trial, the Plaintiff/Respondent prevailed. Aggrieved by the outcome of the trial, the Defendant/Applicant has filed a Notice of Appeal and is praying this Court to stay execution of its judgment pending the outcome of the appeal, which in his opinion, has a bright chance of success. In the affidavit in support of the application, particularly paragraphs 8 to 11, the Defendant/ Applicant avers as follows; 1.
